The Federal Bar Association Chicago Chapter invites you to a timely and impactful webinar exploring one of the most significant recent decisions in federal administrative law. On June 28, 2024, the U.S. Supreme Court overturned Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc., in the cases of Loper Bright Enterprises v. Raimondo and Relentless Inc. v. Department of Commerce. The Chevron doctrine, which had governed federal courts’ deference to agency interpretations of ambiguous statutes for nearly four decades, was a cornerstone of administrative law. Its reversal will have far-reaching implications on the balance between federal agencies and the courts in statutory interpretation.
Our experienced panel will delve into the Court’s rationale for finding the Chevron framework inconsistent with Section 706 of the Administrative Procedure Act (APA), which mandates that courts independently interpret laws without deference to agency interpretations. The session will provide a deep dive into the potential consequences of this landmark decision and how it may reshape federal litigation, legislative drafting, and agency operations moving forward.

Kyle R. Freeny, a former federal prosecutor for the Special Counsel’s Office and the Department of Justice’s Money Laundering and Asset Recovery Section (MLARS), brings over a decade of high-profile federal government experience to her work in government and internal investigations, enforcement matters, and complex litigation. She has particular expertise in financial crime, cross-border investigations, anti-money laundering, anti-corruption, and asset forfeiture. Notably, Kyle was part of Robert Mueller’s team investigating Russian interference in the 2016 election, where she led financial tracing and money laundering investigations.
