On June 28, 2024, the U.S. Supreme Court overturned Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc., in the cases of Loper Bright Enterprises v. Raimondo and Relentless Inc. v. Department of Commerce. The Chevron doctrine, which had governed federal courts’ deference to agency interpretations of ambiguous statutes for nearly four decades, was a cornerstone of administrative law. Its reversal will have far-reaching implications on the balance between federal agencies and the courts in statutory interpretation.

Our experienced panel will delve into the Court’s rationale for finding the Chevron framework inconsistent with Section 706 of the Administrative Procedure Act (APA), which mandates that courts independently interpret laws without deference to agency interpretations.
